DescriptionConcerning Mrs Florence Emily Barger deceased. Asking for assistance in advising their clients, the Royal Society, as to the attitude they should adopt in connection with their rights in this matter. They enclose;
1. Agreement under sale of 10 August 1959 made between (1) Harold Barger, (2) Evert Hugh Barger, and (3) Paul E M Shaw and another
2. Instructions to Counsel to advise and to settle proceedings and evidence under the Variation of Trusts Act, 1958
3. Opinion of Counsel, Mr J A R Finlay, of 27 June 1963
4. Opinion of Counsel, Mr J A R Finlay, of 13 April 1965

Evident from the above that the Royal Society have a remote interest following on certain trusts for the benefit of prior objects. Would be difficult to estimate cost of carying these trusts out; instructions to Counsel indicate circumstances in which the Agreement under Seal was entered into, and two opinions of Counsel indicate the correct method of administering the trusts of the Agreement and the posiiton of the Royal Society; correspondence shows basis on which the Royal Society have been approached and asked to accept a small payment in sittelment of their interest. No information given as to funds, or any estimate of the probable expense of carrying out the trusts. It is wished to dispose of certain outstanding questions, and to extrend the trusts for the benefit of those having a prior interest to the Royal Society, by using income for their maintenance, which would render it less likely that the Royal Society would benefit.

If amount is small, the Royal Society would not wish to spend an undue amount of time in dealilng with the matter. At the same time, if any amount is received, it will be held by the Royal Society as a Trustee on charitable trusts. Therefore before a decision can be taken, further information should be asked as to the capital, and the ages and circumstances of teh children and the estimated expenditure.

Suggeted this may be discussed i conference in the first instance, in which case Mr Le Grand the accountant of the Royal Society and Mr Buller from Bristows, Cooke and Carpmael would attend any appointment.
