Description Recites;
1. Mr Harold and Mr Evert are desirous of entering into an arrangement for the management of the affairs of their mother Florence Emily Barger of 102 Hampstead Way, London, NW11 (hereafter called 'Mrs Barger'
1. Mrs Barger has executed a Will by which she has given her Residuary Estate to Mr Evert absolutely and has made him sole Executor but has expressed a wish that Mr Evert should our of her REsiduary Estate made provision as is hereinafter contained
3. Mr Haold has in the United States of Merica a fund (hereiinafter called 'the American Fund') which is invested in his name but which he has kept separate from other investments of his own and which fund originated from a free gift made by Mrs Barger to him in 1959
Now this deed winesses;
1. Mr Evert to furnish Mr Harold with a Sttement of Mrs Barger's assets and liabilities in the United Kingdom and Mr Harold will furnish Mr Evert with a statement in respect of the American Fund
2. Mrs Barger's share certificates, title deeds and other securities to remain in the custody of Barclays Bank ltd under an arrangement whereby the Bank will release them or lend them on the security only on the joint sugnatures of Mr evert and Mr Paul Edmund Michael Shaw
3. Under Power fo Attorney from Mrs Barger Mr Evert has full authority for expending the income from her assets in the United Kingdom for her household and other expenses but if this income shall be insufficient for these purposes then capital can be realised to augment such inclome.
4. If requested by Mr Evert Mr Harold will remit to Mrs Barger's account the current net income from the American Fund.
5. Mr Evert to prepare a brief summary account of Mrs Barger's assets and liabilities and income and expenditure at the end of each calendar year and will supply Mr Harold and Mr Shaw with copies
6. After the death of Mrs Barger neither Mr Harold nor Mr Evert will contest the validity of the Will executed by Mrs Barger on 26 January 1958 and now in existence.
7. Mr Evert or Mr Evert and Mr HArold shall take reasonable steps to procure that the estate of Mrs Barger shall be fully administered according to law as soon as may be after Mrs Barger's death, and forthwith transfer to the Trustees the whole of the net residue of the estate to which they may be entitled by Mr BARger's will.
8. After Mrs Barger's death Mr Harold will transfer to the Trustees as a free gift the American Fund
9. The Trustees will hold and apply the residuary estate (the Trust Fund) as follows;
a. £200 to William Baxter of 1 The Rdgeway, London NW11
b. £450 per annum to Harriet Robertson , housekeeper to Mrs Barger, of 102 Hampstead Way, London NW11
c. Income and capital of the Trust Fund to educatin of Mr Evert's three childrem Jennifer BArger, Clive George Barger and Kirsten Barger
d. After the above the Trustees may hold the money for Mr Harold, his wife Gwyneth Barger, Mr Evert, his wife Freda Molly Barger and his three children
e. Such provision only to be applied on the above in (d) in case of serious illness, disability or other personal emeregency.
f. Instead of (e) above Trustees may expend ncome and capital on any one of the seven persons listed
g. Trustees to spend income and capital on purpose above listed, but any that remains shall be tranferred to the Royal Society for the purpose of reserch in Bio-chemistry
10. Trustees have full power of investment in any asset
